Contractor Certification

Contractor certification is the registration a labour authority grants a provider that meets capital and compliance tests. It is evidence of legitimacy, not a guarantee, because a tribunal can still look past the certificate at how the work is really run.

Most jurisdictions that regulate contracting operate some version of it — a register exists, entry requires proof, and unregistered operators are presumed to be supplying labour unlawfully.

The certificate does real work in a procurement process. It filters out operators who cannot demonstrate capital, tax compliance or a lawful employment structure before anyone reads a proposal.

What it cannot do is describe how the contract will actually be performed — which is where most disputes originate.

How it works

A certification regime sets entry conditions, checks them once, and publishes the result. Conditions typically cover paid-up capital, ownership of tools or premises, tax registration, social-contribution compliance and an undertaking to observe labour standards.

The Philippine version is the clearest example. A contractor must hold a certificate of registration from the labour department alongside substantial capital and its own equipment.

Registration does not displace the statutory test. Article 106 of the Labor Code still lets the authorities restrict or prohibit contracting arrangements to protect workers’ rights, whatever the register says.

That gap is the whole reason vendor diligence exists. The certificate answers a screening question — your audit has to answer the operating one.

Certificates also expire. A provider that was compliant when it won the work can drift, and the renewal date is the cheapest early-warning signal a buyer has.

Certification shows up differently at each stage of a sourcing process. The situations below are where it genuinely changes an outcome rather than sitting in a compliance folder.

A bank screening thirty Philippine providers eliminates nine at first pass for having no current certificate. That is the filter working exactly as intended, before anyone spends time on proposals.

An insurer verifies a certificate directly with the issuing office and finds the registration lapsed four months earlier. The provider had supplied a scan of the expired document without comment.

A retailer’s audit finds a certified contractor running its account entirely on client-supplied laptops in client-leased space. The certificate is genuine and the arrangement still fails the investment test.

A technology buyer builds renewal dates into its vendor register and gets an automatic alert ninety days out. Two providers renew late, which becomes a discussion rather than a discovery during an audit.

Not quite. Certification here is a statutory registration a regulator grants; accreditation usually refers to an industry body recognising capability rather than legality.

It runs for a fixed term and must be renewed. Treat the expiry date as a contract-management milestone rather than a filing detail.

Can a client rely on a supplier’s copy?

It should not. Copies are easy to produce and easy to keep after expiry, so verification against the issuing register is the only reliable check.

Does certification prevent a labour-only finding?

No. It creates a presumption of legitimacy that evidence about actual operations can displace.

What if a provider is uncertified but competent?

Competence is not the issue. Engaging an unregistered contractor exposes the buyer to being treated as the workers’ direct employer.

Should certification status appear in the contract?

Yes, as a continuing warranty rather than a one-off representation.
