Legal transcription outsourcing is contracting an outside team to turn recorded legal proceedings and dictation into accurate written records. The work demands verbatim accuracy and strict confidentiality, because the output can end up in evidence in front of a court.

Accuracy expectations here are unlike general transcription — a misheard word in a deposition is not a typo, and it can change what a witness is recorded as saying.

Volume is lumpy and deadline-driven — a firm might need nothing for a fortnight, then eight hours of hearing audio turned around overnight.

Confidentiality is the gating question — privileged material is leaving the building, and the contract has to say exactly who may touch it.

How it works

Legal transcription splits by source. Court and hearing audio is usually multi-speaker and needs speaker identification; dictation from a solicitor is single-speaker and faster; deposition audio sits in between and often runs longest.

Turnaround tiers do the pricing work. Standard is three to five days, expedited is next day, and same-day rates commonly run at two or three times the standard rate.

Retention rules follow the file. 36 CFR Part 1236 sets electronic records management requirements that shape how long transcripts and their source audio must survive.

Speaker identification is where most of the effort hides. A four-way hearing needs each voice attributed correctly, and a transcript that mislabels who said what is worse than none.

What accuracy standard should be specified?

Ask for 99.5% verbatim on evidentiary material and 99% on internal dictation. State how accuracy is measured, or the number means very little.

Does verbatim mean every word?

For evidence, yes, including false starts and hesitations. Internal notes are usually cleaned up, so the contract should say which style applies where.

How is confidentiality handled?

Through named personnel, background checks, restricted access, and a written destruction schedule. A firm-level agreement alone does not cover individual access.

Can speech recognition replace it?

Only as a first pass. Automated drafts still need human review on multi-speaker audio, and privileged material rarely belongs in a general recognition service.

Per audio minute, adjusted for turnaround and speaker count. Poor audio usually attracts a surcharge, so recording quality is worth investing in.
