Rest day overtime is paid work performed on an employee’s scheduled day off, typically a weekend or rotating rest day. In the Philippines, it triggers a 30% premium on the daily rate under Article 93 of the Labor Code, with extra loading if the day is also a holiday or exceeds eight hours.

The concept sits at the intersection of labor law, payroll, and workforce planning. It’s not the same as standard daily overtime, which kicks in when you work past your eight-hour shift on a normal workday. Rest day overtime is jurisdictional too, so a US employer running a Manila team needs both rule sets to pay correctly.

How it works

Rest day overtime is governed by national labor codes, collective bargaining agreements, and individual employment contracts. In the Philippines, the Department of Labor and Employment (DOLE) sets the multipliers. The US Fair Labor Standards Act has no rest-day rule per se; it triggers overtime on hours past 40 in a workweek. The EU Working Time Directive caps the average week at 48 hours and mandates a 24-hour weekly rest.

Is rest day overtime mandatory?

Generally no. Most labor codes treat it as voluntary, with narrow exceptions for emergencies, perishable work, or urgent business needs. In the Philippines, Article 92 lists the cases where an employer can compel rest day work, and the WHO and ILO have urged governments to ban mandatory overtime outright.

How is rest day overtime calculated in the Philippines?

You take the daily rate, add 30%, then add another 30% for any hour past the eighth. If the rest day also falls on a special non-working holiday, the loading rises to 50%. On a regular holiday that’s also a rest day, it’s 260% of the daily rate.

Does rest day overtime stack with night differential?

Yes. In the Philippines, the 10% night differential applies on top of the rest day premium for any hours between 10 pm and 6 am. Payroll systems compute them sequentially so you don’t lose either loading.

What’s the difference between rest day overtime and regular overtime?

Regular overtime is hours past the daily limit, usually eight, on a normal workday. Rest day overtime is any work on a scheduled day off, with a separate and usually higher premium. The two can overlap if you work a long shift on your rest day.
